These general terms and conditions (hereinafter referred to as "terms and conditions"), regulate the rights and obligations for all legally binding contracts between the artistic wood design Bergmann GmbH (hereinafter referred to as "artistic wood design") and the customer of the artistic wood design, which our Benefits. By submitting a legally binding declaration, the customer declares that he/she has taken note of these terms and conditions and accepted them as the content of the contract.

1 Booking & Payment of Adventurous Nights/ Conclusion of Contract / Prices / Costs

With your request for booking and / or reservation you make an offer to conclude a contract to which you are bound for a period of 14 days. The commitment will be shortened accordingly if the request to stay / conclude a contract relates to a period that is earlier than these 14 days. At the end of this date or the 14 days, whichever comes first, you are no longer bound by your offer. After receipt of your request for booking and / or reservation or booking, we check whether the desired accommodation is free and you will receive from us, in the event that the booking is possible, a corresponding booking confirmation, which is to be understood as our acceptance, as well a down payment invoice by mail, if there is no mail address, by post. This down payment invoice (amounting to 40% of the total price) must be paid within 7 days (account receipt). The remaining 60% of the amount, if not transferred in advance, to be paid upon arrival in cash or by EC direct debit. Unless otherwise agreed, only the service and price information on our website is specified by our booking confirmation.

2 Arrival and reception of accommodation facilities / arrival / departure

The arrival at Kulturinsel can be made from 10a.m. The check-in for the accommodation can be made from 15:30p.m. The check-in for the Behütum as well as for the tent and caravan parking lot can be made from 12p.m. On the day of departure, the check-out must be done before 11a.m.

Please note that our reception is only open until 6p.m. If you arrive after 6p.m., please inform us 2 days prior to arrival at Tel .: 035891 - 49113.

Furthermore, we point out that driving on the grounds of Kulturinsel for safety reasons is not permitted. For the transport of your luggage we provide wheelbarrows.

The Behütum, Fassbaumhaus, Mystische Mühle, Baumaquarium, Waldbett, Erdversteck, the Vögelbaumhütten as well as the tent and caravan parking lot lie outside of the leisure park area. If necessary, the car can be parked by the Behütum or campground for a fee of 6.00 €, otherwise the car must be parked in the official car park opposite the West portal.

3 Specifications of Adventurous Nights

The accommodations Kid's Tree House (Kinderbaumhaus), Woodland Settlement (Waldsiedlum), Woodland Settlement-Suite (Waldsiedlum Suite), Forest Bed (Waldbett), and Earth House (Erdhaus) are to be booked with an adventure pass, apart from Behütum, Tree House Camp (Baumhauscamp), and camping. These are defined according to their individual service descriptions.

3.1 Adventure Pass Basic Package 

This category is bookable for adventure sleepers in the Kid’s Tree House (Kinderbaumhaus), Woodland Settlement (Waldsiedlum), Forest Bed (Waldbett), Earthhouse (Erdhaus) and possibly Behütum, Bird Tree Huts (Vögelbaumhütten), Tree House Camp (Baumhauscamp) or for campers and includes park entry, parking fee, breakfast, evening meal and the midnight adventure. The breakfast buffet is available from 8: 00-10:30 in the Baumstammlokal for overnight guests. Upon arrival, the guest receives a breakfast voucher, which must be handed to our staff at breakfast. The evening meal is designed as a mummified voucher, which can be redeemed in all dining facilities of Kulturinsel Einsiedel for food. Its price is € 10.00 per adult and € 7.00 per child.

3.2 Adventure Pass Exclusive Package

This category is bookable for adventure sleepers in the Kinderbaumhaus, Waldsiedlum, Waldbett, Erdhaus and possibly Behütum, Vögelbaumhütten, Baumhauscamp or for campers and includes an unforgettable evening at the KRÖNUM - Theater zum Essen with coronation menu, park entrance, parking fee, breakfast and the midnight adventure.

The breakfast buffet is available from 8-10.30 a.m. in the Baumstammlokal for overnight guests. Upon arrival, the guest receives a breakfast voucher, which must be handed to our staff at breakfast.

3.3 Adventurous Night in the Treehouse Hotel (Baumhaushotel)

Overnight Price: 230,00 € to 340,00 € per tree house incl. Park entrance (incl. 7% VAT on overnight stay and incl. 19% VAT on park entrance), plus breakfast adults 12,00 € pp, child 6,00 € pp (each incl. 19% VAT).

In each tree house there is place for max. 4 or 6 people. The tree houses are equipped with WC, mattresses, bed linen and towels. The tree houses, Thor Alfons Astpalast, Bergamos Gästenest and Olves Baumburg also have a small kitchen, a bathroom with shower. All tree houses have electric heating. The respective modalities arise from the ordering process.

3.4 Adventurous Night in the Island Treehouse (InselBaumhaus)

Overnight Price: 230,00 € for the treehouse island incl. Park entrance (incl. 7% VAT on overnight accomodation as well as incl. 19% VAT on park entrance), plus breakfast adults 12,00 € p.P., child 6,00 € p.P. (each incl. 19% VAT). The respective modalities arise from the ordering process.

The InselBaumhaus is located on an island in a pond outside the leisure park grounds, by the Behütum, where up to two adults and two children can stay overnight. It is equipped with comfortable beds including bed linen, towels and a toilet. The island tree house has a small wood stove. However, a tree-only wall cannot fully heat the tree house. Sanitary facilities are located in the area of ​​the Behütum. The pond is designed as a fire pond and not suitable for swimming. Therefore, the respective adults are responsible for ensuring that the children do not enter the pond and the immediate shore.

3.5 Adventurous Night on a Tree Bed

Overnight Price: 190,00€ per tree bed with own toilet or 160,00 € without toilet incl. Park entrance (incl. 7% VAT on overnight stay and incl. 19% VAT on park entrance), plus breakfast adults 12,00 € pp, child € 6.00 pp (each incl. 19% VAT) In each tree bed with toilet there is place for max. 2 adults and 3 children and in tree beds without toilet the max. is 2 adults and 1 child. All tree beds are equipped with mattresses, bed linen and towels.

Attention, one of the tree beds is located outside of the leisure park area (tree bed "Geile Weide"). The tree beds have a small wood stove, but are not fully heated due to their open design.

3.6 Adventurous Night in a Dream Cocoon (Traumkokon)

Price per night: 190,00 € per Traumkokon incl. Park entrance (incl. 7% VAT on overnight stay as well as 19% VAT on entrance fee), plus breakfast adults 12,00 € p.p., child 6,00 € p.p. (each incl. 19% VAT). The respective modalities arise from the ordering process.

In the dream cocoon up to 2 adults can stay overnight. This is equipped with toilet, mattresses, bed linen and towels. For the combination lock to the door of the Traumkokon you need to deposit at check in a deposit of 15,00 €, which you get back on departure. The Traumkokon is not heated.

3.7 Adventurous Night in a Children’s Tree House (Kinderbaumhaus)

Overnight Price: per child 47,50 € Adventure Pass Basic Package Swabian Scot or 49,50 € Adventure Pass Extra Class The children's tree house is equipped with mattresses, bed linen and towels and towels and can accommodate 2-3 children. The correspondingly booked adventure passes are described under 3.1 and 3.2 respectively (all prices incl. 7% or 19% VAT). For the combination lock of the Kinderbaumhaus you need to deposit a deposit of 15,00 € at check-in, which you will get back on departure. The children's tree houses are not heated.

3.8 Adventurous Nightin the Woodland Settlement Suite (Waldsiedlumsuite)

Accommodation price: 90,00 € for the Waldsiedlumsuite (including 7% VAT) plus Adventure Pass Basic Package Swabian Scot: Adult € 31.50, Child € 20.00 or plus Adventure Pass Extra Class: Adults € 63.50, children € 22.00  (each incl. 19% VAT). The alcoves (sleeping niches) and the common room are available for up to 6 people and are equipped with mattresses, bedding and towels and towels. The appropriately booked adventure passes are described under 3.1 and 3.2 respectively. For the combination lock of the Waldsiedlumsuite you need to deposit at check-in a deposit of 15,00 €, which you get back on departure. The suite is not heated.

3.9 Adventurous Nightin the Woodland Settlement (Waldsiedlum)

Overnight Price incl. Adventure Pass Basic Package Swabian Scot: Adults € 50.00, Child € 36.50 Overnight Price incl. Adventure Pass Extra Class: Adults € 82.00, Child € 38.50 (all prices incl. 7% or 19% VAT) .).

The alcoves (sleeping niches) are available for 2 or 4 people and are equipped with mattresses, bedding and towels and towels. The appropriately booked adventure passes are described under 3.1 and 3.2 respectively. For the combination lock of the Waldsiedlum you need to deposit at check-in a deposit of 15,00 €, which you get back on departure. The alcoves are not heated.

3.10 Adventurous Nightin the Earth house (Erdhaus)

Overnight Price incl. Adventure Pass Basic package Swabian Scot: Adults € 50.00, child € 36.50. Accommodation price incl. Adventure pass Extra class: adults € 82.00, child € 38.50 (all prices include 7% or 19% VAT).

In Erdhaus up to 28 people can stay overnight and it is a shared accommodation. For the key to the gates of the Erdhaus deposit at check in a deposit of 15,00 €, which you get back on departure. Please do not forget your sleeping bag! The appropriately booked adventure passes are described under 3.1 and 3.2 respectively. The Erdhaus can be heated by a campfire in the middle of the house.

3.11 Adventurous Nightin the Birdy Tree Bed (Vögelbaumbett)

Overnight Price: 230,00 € for the Vögelbaumbett (incl. 7% VAT on overnight stay and incl. 19% VAT on Park Entrance), plus breakfast adults 12,00 € p.p., child 6,00 € p.p. (each incl. 19% VAT) In the Vögelbaumbett up to 4 adults and 3 children can stay overnight. The Vögelbaumbett is equipped with toilet, mattresses, bed linen and towels. It is not heated.

3.12 Adventurous Night in the Rock Nest (Felsennest)

Overnight Price: 190,00 € for the Felsennest (including 7% VAT on overnight accommodation and 19% VAT on park entrance), plus breakfast adults 12,00 € p.p., child 6,00 € p.p. (each incl. 19% VAT). In the rock nest up to 2 adults and 2 children can stay overnight. The Felsennest is equipped with toilet, mattresses, bed linen and towels. The Felsennest is not heated.

3.13 Adventurous Nightin a Tree-Love-Shack (Vögelbaumhütte)

Overnight Price: € 40.00 for the Vögelbaumhütte (including 7% VAT) The Vögelbaumhütten are not located on the grounds of the green-ringed leisure park - but very close. The overnight stay does not include entrance fee, evening meal or breakfast. Leisure park visitors can book a breakfast in the Baumstammlokal (adult: 12,00 €, child: 6,00 € incl. 19% VAT) or one of the adventure passes. The appropriately booked adventure passes are described under 3.1 and 3.2 respectively. Please do not forget your sleeping bag! The cabins are not heated.

3.14 Adventurous Night in the Haunted Mill (Mystischer Mühle)

Overnight Price: € 340.00 for the Mystische Mühle (including 7% VAT on overnight accommodation and incl. 19% VAT on park entrance), plus breakfast adults € 12.00 p.p., child € 6.00 p.p. (each incl. 19% VAT). The Mystische Mühle is not on the grounds of the green-ringed leisure park - but very close. The Mystische Mühle can host up to 2 adults and 2 children. The Mystische Mühle is equipped with toilet, mattresses, bed linen and towels. The Mystische Mühle has electric heating.

3.15 Adventurous Night in a Barrel Tree House (Fassbaumhaus)

Overnight Price: 340,00 € for the Fassbaumhaus (including 7% VAT on overnight stay and incl. 19% VAT on Park entrance), plus breakfast adults 12,00 € p.p., child 6,00 € p.p. (each incl. 19% VAT). The Fassbaumhaus is not on the grounds of the green-ringed leisure park - but in very close. The barrel house can host up to 2 adults and 4 children. The Fassbaumhaus is equipped with toilet, mattresses, bed linen and towels. The Fassbaumhaus has an electric heater.

3.16 Adventurous Night in the Tree Yurt (Baumjurte)

Overnight Price: 340,00 € for the Baumjurte (including 7% VAT on accommodation and 19% VAT on Park entrance), plus breakfast adults 12,00 € p.p., child 6,00 € p.p. (each incl. 19% VAT). The Baumjurte is not on the grounds of the green-ringed leisure park - but very close. The Baumjurte can host up to 4 adults and 6 children. The Baumjurte is equipped with WC, mattresses, bed linen and towels. The Baumjurte is not heated.

3.17 Adventurous Night in the Tree House Camp (Baumhauscamp)

Overnight Price: € 25.00 per double bed (including 7% VAT) The Baumhauscamp is not located on the grounds of the green-ringed leisure park – but very close to the neighboring Neisse in Poland near the village of Bielawa Dolna. The overnight stay does not include entrance fee, evening meal or breakfast. The leisure park visitors can book a breakfast in the Baumstammlokal (adult: 12,00 €, child: 6,00 €) or one of the adventure passes. The appropriately booked adventure passes are described under 3.1 and 3.2 respectively. Please do not forget your sleeping bag! The Baumhauscamp is not heated.

3.18 Adventurous Nightin the Behütum

Adults € 13.50, children € 11.50 (including 7% VAT). The Behütum is not on the grounds of the green-ringed leisure park – but very close. The overnight stay does not include admission, nor evening meal or breakfast. Leisure park visitors can book breakfast in the Baumstammlokal (adult: 12,00 €, child: 6,00 €). Please do not forget your mattress and sleeping bag! The Behütum is not heated.

3.19 Adventurous Nightin the Behütum including Adventure Pass

Overnight Price incl. Adventure Pass Basic package: Adults € 45.00, child € 31.50. Overnight Price incl. Adventure Pass Exclusive Package: adults € 77.00, child € 33.50 (all prices include 7% or 19% VAT). The Behütum is not located on the grounds of Kulturinsel but in the very close. Please do not forget your mattress and sleeping bag! The appropriately booked adventure passes are described under 3.1 and 3.2 respectively.

3.20 Campsite or Caravan Pitch

Per tent and per night 2.00 €, caravan parking per night electricity included 8,00 €, car on the campsite 6,00 €. In addition there are 5.50 € per adult, 3.50 € per child (each incl. 7% VAT) for the overnight stay.

The campsite is located opposite Kulturinsel, very close. The pitches including electricity are opposite the main entrance on the overnight car park. You can book a breakfast at Baumstammlokal (8: 00-10: 30), for 12,00 € net per adult and 6,00 € net per child. Tents and caravans are only to be set up on the designated shelves. The rear area near the fire extinguishing pond is only intended for cars (right) or adventurous nights in the Baumbett, Inselbaumhaus, Fassbaumhaus, Mystische Mühle, Baumaquarium, Erdversteck, Waldbett oder Vögelbaumhütten (left). For an additional booking of the KRÖNUM theater for dinner, adult campers receive a discount of € 14.00 per person. Children cost 9.00 €. A booking of the overnight stay with adventure pass is possible: Adventure pass Basic package Swabian Scotsman: Adults € 37.00, Child € 23.50 Adventure Pass Extra class: adults € 69.00, child € 25.50 (all prices incl. 19% VAT.).

3.21 Adventurous Night in the Tree Aquarium (Baumaquarium)

Overnight Price: 340,00 € for the Baumaquarium (including 7% VAT on overnight stay and incl. 19% VAT on park entrance), plus breakfast adults 12,00 € p.p., child 6,00 € p.p. (each incl. 19% VAT). The tree aquarium is not on the grounds of the green-ringed leisure park - but very close. The Baumaquarium can host up to 6 people.

The Baumaquarium is equipped with toilet, shower, mattresses, bed linen and towels. The tree aquarium is not heated.

3.22 Adventurous Nightin Dragomir’s Shack (Dragomir’s Erdversteck)

Overnight Price: 230,00 € for the Erdversteck (including 7% VAT on overnight stay and including 19% VAT on Park entrance), plus breakfast adults 12,00 € p.p., child 6,00 € p.p. (each incl. 19% VAT). The Erdversteck is not on the grounds of the green-ringed leisure park - but very close. The Erdversteck can host 2 adults and a maximum of 2 little children. The Erdversteck is equipped with toilet, shower, mattresses, bed linen and towels. The Erdversteck has a heater.

3.23 Adventurous Nightin the Forest Bed (Waldbett)

Accommodation price: 90,00 € for the Waldbett (including 7% VAT) plus adventure pass Basic package Swabian Scotsman: Adults € 31.50, children € 20.00 or plus adventure pass Extra class: adults € 63.50, child 22.00 € (each incl. 19% VAT). The Waldbett is not on the grounds of the green-ringed leisure park - but very close. The Waldbett can host up to 2 adults and 2 children. The forest bed is equipped with mattresses, bed linen and towels. It does not have its own toilet or shower. Public sanitary facilities are very close. The forest bed is not heated.

3.24 Adventurous Nightin the Nomad Tree (Baumnomade)

Overnight Price: 230,00 € for the Baumnomade (including 7% VAT on overnight stay and incl. 19% VAT on Park entrance), plus breakfast adults 12,00 € p.p., child 6,00 € p.p. (each incl. 19% VAT). The Baumnomade can host up to 2 adults and a maximum of 2 small children. The tree nomad is equipped with mattresses, bed linen and towels. It is not heated. Toilets and showers are very close.

3.25 KRÖNUM – Theatre for Dinner

Adults 62,00 €, children 13,00 € (each incl. 19% VAT) For overnight guests the price for adults is 49,00 € and for children 13,00 € (each incl. 19% VAT). The KRÖNUM - Theater for dinner takes place in the old-Turkish coronation hall, the Krönum, and it is a full-length program of about 3.5 hours. The price includes a high-quality stage show with fabulous artists as well as a multi-course pampering menu. The beginning of the amazing time travel is at 6p.m. at the "Verkleidum". Drinks are not included.

4 Cancellations & Changes of Reservation

4.1 Overnight Stays

In the period of 60 to 14 days before departure, 40% of the invoice amount will be charged as a cancellation fee. 14 days prior to the departure 80% of the invoice amount will be charged. The first transfer until 4 weeks before arrival is processed free of charge, from the second transfer 4 weeks before arrival we charge a processing fee of 8.50 €.

From 4 weeks prior to arrival, we charge 10% of the invoice amount as a handling fee for rebooking. 48 hours before arrival no changes can be made. In any case, the customer reserves the right to prove that damage was not incurred at the respective amount.

4.2 Krönum – Theatre for Dinner

It is possible to cancel the tickets for the KRÖNUM Theater for dinner up to 14 days before the event free of charge. Only written cancellations are possible. In case of a cancellation within 14 days before the date of the event a refund of the entrance fee is not possible. The guest can only move the tickets to another event date. In any case, the customer reserves the right to prove that damage was not incurred at the respective amount.

4.3. Gastronomic Services at Celebrations

Only written cancellations are possible. Up to 14 days before the event, 10% of the invoice amount will be charged, as an expense balance for the planning services already provided. If the cancellation is less than 7 days before the event, 30% of the invoice amount will be charged. In the case of booked external artist services, the contractual agreements and deadlines entered into with the artist apply. In any case, the customer reserves the right to prove that damage was not incurred at the respective amount.

4.4 Group Offers, Games and Guided Tours

Only written cancellations are possible. Up to 14 days before departure, no cancellation fees will be charged. If canceled less than 14 days before the date of the offer, 80% of the invoice will be charged. In any case, the customer reserves the right to prove that damage was not incurred at the respective amount.

4.5 Vouchers for Park Admission and Overnight Stays from MyDays

For Mydays bookings, our tickets are already charged from the first day of booking with a cancellation fee of 30% of the retail price. In any case, the customer reserves the right to prove that damage was not incurred at the respective amount.

5 Liability / Disclaimer

The guest is fully liable for willful destruction. The guest undertakes to treat the property with the necessary care.

The artistic wood design is not liable for lost wardrobe or for lost or lost valuables, unless gross negligence can be blamed. The artistic wood design takes over the cloakroom no care responsibilities.

Customer claims for compensation are excluded. This does not apply to claims for damages by the customer resulting from injury to life, limbs or health or from the breach of essential contractual obligations (cardinal obligations) as well as liability for other damages resulting from intentional or grossly negligent breach of duty based by the Künstlerischen Holzgestaltung, its legal representatives or vicarious agents. Significant contractual obligations are those whose fulfillment is necessary to achieve the objective of the contract.

In the event of a breach of essential contractual obligations, the Künstlerische Holzgestaltung shall only be liable for the contractually typical, foreseeable damage if this was simply caused by negligence, unless it concerns claims for damages of the customer resulting from injury to life, limbs or health. As far as the liability of the artistic wood design, according to the above paragraphs is excluded or limited, this also applies to the liability of their vicarious agents. The provisions of the Product Liability Act remain unaffected.

6 Gift Vouchers

Our gift vouchers can be purchased for free for a self-chosen amount. On the other hand, it is possible to have the vouchers issued for a specific service (for example, an overnight stay at the Baumhaushotel). For a period of 3 years from the date of issue, the vouchers remain valid. The period of 3 years begins at the end of the year in which the voucher has been issued. The voucher order is binding after receipt of payment and cannot be cancelled. The vouchers and any remaining amounts cannot be paid out.

7 Other Regulations

Attention! If you stay with us and we celebrate a big party, the admission ticket’s price increases.

This applies from 31.08-02.09.2018 (Folklorum). (On Folklorum weekend the Adventure Pass is not bookable.) Only the overnight stay can be booked, tree house: from 200,00€ for 4 to 6 people, InselBaumhaus: 200,00€ for 2 adults + 2 children, Baumbetts: 160, 00 for max 2 adults + 3 children, Traumkokon: 160,00€ for 2 adults, children tree house: child 27,50€, Waldsiedlumsuite: 90,00€ for max 6 people, Waldsiedlum & Erdhaus: adults 18, 50€ and child 16,50€, in the Behütum for 13,50€ adults and 11,50€ child, (without breakfast, evening meal, admission, incl. 7% VAT) Fassbaumhaus: 300,00€ max 6 adults , Mystische Mühle 300,00€ max 4 adults, Baumaquarium 300,00€ max 6 people, Waldbett 90,00€ max 2 adults + 2 children, Dragomir’s Erdversteck & Baumnomade 200,00 € max 2 adults and 2 small children , Felsennest: 160,00€ max 2 adults and 2 children, Baumjurte: 300,00€ max 2 adults and 2 children, Vögelbaumhütten 40,00€ max 2 adults). This is also separately agreed with the respective order.

The number of sleeping places in the Behütums and Erdhaus are set, if the booker does not book all the sleeping spaces of the accommodation, it may happen that other guests occupy the remaining places.

For a group of at least 15 people, the remaining places in the Erdhaus are not available for booking. For smaller groups, though, the booking is open to others to replenish the remaining places (up to 15), per bed a flat rate of € 18.50 to pay to stay in the Erdhaus house alone. If the rooms of the overnight stay are left excessively dirty, we charge a cleaning fee of 25.00 € due to the need of more staff.

For group bookings, a single billing must be made.

Food orders for groups must be received written no later than one week before the visit and will only become binding upon our confirmation.

Regulation for groups of children (day visit): For 15 children, two carers are granted free admission. For each additional 10 children, an additional free space for carers will be granted. Likewise, bus drivers and tour guides are granted free admission.

9 Photography, Filming and Advertising

Within Kulturinsel’s area and also in the play area Bielawa Dolnas in Poland and strengthened during Kulturinsel’s festivals at all action sites we reserve the right to make photos and films, which can also represent guests. These photos and films can sometimes be used for advertising and public display of the German or Polish park grounds and their own festivals. You have the right to prohibit us from using these images at any time.

10. Unusual Incidents / Final Clauses

For special incidents or complaints please contact Elke Williger Tel .: 035891 - 49117 or Jürgen Bergmann and Doreen Stopporka (Chiefs). You will find them behind the gate - where "private" is advertised. The invalidity of individual provisions of these terms and conditions does not affect the validity of the remaining clauses. Instead of an ineffective provision, an effective provision comes closest to its economic content. The same applies to any contract gaps. The law of the Federal Republic of Germany applies excluding the UN sales law.
